Inside Adhyaya 5

How it unfolds

  1. The problem

Undivided kin-groups (piṇḍa) generate recurring disputes over what counts as ancestral vs self-acquired property, when severance (vicchinna) is legally triggered, and who inherits on sonless death—conflicts that can escalate into violence, stall production, and clog courts, thereby threatening revenue stability and the king’s coercive credibility.

  2. The answer

The chapter standardizes rules for (a) classifying property into pitṛdravyam (paternal/ancestral) and svayaṃ ārjitam (self-acquired), (b) determining when a joint family remains a single economic unit (piṇḍa) versus when it is severed (vicchinna) so that equal partition applies, and (c) fixing heir-order and share-allocation for descendants inheriting undivided ancestral wealth, especially in cases of sonless death—so transfers occur predictably and with minimal litigation.

  3. Where it lands

By converting kinship wealth into a legible, enforceable scheme of partition and succession, the court prevents private war, reduces opportunistic fragmentation and forum-shopping, preserves productive continuity, and secures the fiscal base; disciplined domestic order becomes a strategic asset for the vijigīṣu’s outward ambitions.

The pillar of the state

Treasury (Kośa) — secured through orderly succession, predictable property rights, and reduced kinship litigation that otherwise drains revenue and stability.

The focus

Creating predictable, enforceable rules for partition and inheritance to keep households productive, disputes non-violent, and assets transferable without destabilizing the treasury.

Topics covered

  • Property taxonomy: pitṛdravyam vs svayaṃ ārjitam
  • Joint family status: undivided piṇḍa and its legal incidents
  • Severance criteria: vicchinna and the onset of equal partition
  • Equal partition mechanics and share-calculation
  • Heir-order in sonless death (succession ranking)
  • Shares of descendants in undivided ancestral wealth
  • Litigation-minimization and prevention of intra-kin violence
  • State interest: revenue stability and internal consolidation

The policy

  • Who actsThe King as Chief Judge (rājā-dharmapravartaka) acting through the Dharmastha (judge) and court-scribes (lekhaka)
  • Whom it governsHouseholds/joint families (pitṛmantaḥ, bhrātaraḥ, putrāḥ, pautrāḥ, kanyāḥ) disputing paternal estate, self-acquired property, and intestate succession
  • Why force, and how muchDanda here is primarily juridical: the state enforces clear default rules of partition and heir-order to pre-empt feud, prevent concealment/appropriation of assets, and keep taxable/registrable property legible to the crown.

The administration

  • What the state doesCourt adjudication of partition (dāyavibhāga), determination of undivided vs. severed joint estate (piṇḍa), and intestate succession distribution.
  • Precedents and parallelsParallel to Dharmaśāstra inheritance doctrine (e.g., Manu on dāya and heir-order), but Kautilya is more state-administrative: he treats partition rules as instruments to reduce dispute and maintain registrable property; he also sharply distinguishes self-acquired property from paternal estate as a governance simplification.

The philosophy

  • Artha and dharmaDharma is operationalized as predictable inheritance order; Artha is protected by preventing intra-kin expropriation and by preserving productive continuity of households. The state’s ‘ethical’ duty is framed as dispute-minimization and property clarity, which directly sustains revenue and social peace.
  • The strategyDaṇḍa (legal coercion) as default governance; secondarily Sāma (settlement through clear norms) by offering standardized rules that reduce bargaining conflict.

For the administrator

  • Who it is forDharmastha (chief judge) and the court scribes/record-keepers (lekhaka), with oversight by the king’s judicial superintendent
  • The takeawayUse a standardized decision-tree: first classify the asset (ancestral vs self-acquired), then determine family status (piṇḍa vs vicchinna), then apply equal partition or succession order with fixed shares—recording the decree to prevent repeat suits and to keep taxable/liable property continuously identifiable.

How it is written

Prescriptive (rules allocating shares, defining heir-order, and conditions for re-partition).

Imagery

  • Low; the chapter is technical-juridical. The only quasi-organic metaphor is ‘piṇḍa’ (undivided mass/estate) to describe joint property continuity.

Frequently Asked Questions

Household stability through predictable shares and heir-order; fewer feuds and lawsuits; continuity of production in joint families; clearer ownership records that support credit, taxation, and public order—thereby strengthening the treasury and internal security.

This passage itself does not specify a tariff of fines; enforcement is via court decree: wrongful appropriation, concealment of estate, or refusal to honor adjudicated partition would be punished under general theft/fraud/contempt-of-court principles elsewhere in Book 3 (property and procedural offences), including restitution and fines calibrated to the value and intent.
