Sutra 39

बहुषु प्रत्यासन्नं धार्मिकं भर्मसमर्थं कनिष्ठमभार्यं वा ॥ कZ_०३.४.३९ ॥

bahuṣu pratyāsannaṃ dhārmikaṃ bharmasamarthaṃ kaniṣṭham abhāryaṃ vā

Where there are several (eligible relatives), preference goes to one who is nearest, law-abiding, capable of maintaining the household, the younger (as appropriate), and/or one without a wife.
