
Chapter 252 — व्यवहारकथनं (Vyavahāra-kathana: On Legal Procedure)
阿耆尼在《弓术论》体系中开启一部法理手册,界定“毗耶婆诃罗”(vyavahāra)为辨别正道(naya)与非正道(anaya)之智,并以层层分类加以说明:四分之法、四基之法,以及由四种治国手段而成就。裁判以达摩、法庭程序、习俗(caritra)与王令(raja-śāsana)为根基,强调起诉与答辩的往复,以及证人之关键地位。本章列举传统十八讼事名目:债务、寄存、合伙、撤回赠与、役使与工资、非主售卖、未交付、恶劣交易、违背约定、土地争讼、婚姻事务、继承、暴力、言语侮辱与身体侵害、赌博及杂案,并言其因人之行为可分衍为百种支类。继而阐明法庭伦理(公正之议员sabhya、博学婆罗门)、文书规程、反诉与担保之法、诬告之罚,以及证据次第(文书、占有、证人;若皆缺,则行神判/试验)。末尾论及诉讼时效、名义权与享用之别、欺诈或强迫致无效、减轻情状、盗窃之赔偿与利息规范,确立国王以严整程序为秩序之担保者。
