Adhyaya 14

Book 3 situates the Vijigīṣu’s internal strength in adjudicable order: wealth is not merely collected; it is made possible by reliable exchange. Chapter 14 regulates the wage-contract (bhṛtaka) by defining when non-performance becomes punishable, when incapacity excuses, and how substitution is permitted without enabling collusion or coercive obstruction. The state’s pragmatic objective is to prevent ‘paid idleness’ and ‘forced exclusivity’ that can paralyze production, while still recognizing genuine inability (illness, calamity, degrading work) as grounds for remission or lawful delegation. Kautilya also refines a doctrinal dispute: some ācāryas treat mere presence as completion, but Kautilya insists wages attach to actual performance, with partial-performance rules to prevent employer bad faith. Finally, guild-hired labour is placed under time-bound pledge (ādhi) and procedural duties: replacement and completion are allowed, but the guild cannot remove or impose workers without notifying the employer. This integrates private contracting into state-supervised predictability—an economic precondition for conquest-capacity.

Inside Adhyaya 14

How it unfolds

  1. The problem

Wage-contracts (bhṛtaka) can be exploited through paid idleness, strategic non-performance, coerced exclusivity (blocking substitutes), and collusive guild practices—undermining production, exchange reliability, and thus the king’s internal strength.

  2. The answer

Define performance-based wage entitlement; specify when non-performance is punishable versus excused (illness, calamity, degrading/impermissible work); allow controlled substitution/delegation to ensure completion while preventing obstruction and collusion; add partial-performance rules to deter employer bad faith; regulate guild-hired labour via time-bound pledge (ādhi) and mandatory notice/procedure for replacement or withdrawal.

  3. Where it lands

By tying wages to verifiable work, carving out narrow excuses, and proceduralizing substitution and guild conduct, the state converts private labour contracting into predictable, enforceable exchange—supporting steady production and fiscal-military capacity.

The pillar of the state

Treasury (Kośa) strengthened via enforceable labour-contracts; secondarily Territory (Janapada) via predictable market order.

The focus

Performance-conditioned wages with calibrated excuses and regulated substitution, including guild procedure, to prevent production paralysis and contracting abuse.

Topics covered

  • Bhṛtaka (waged labour) contracts and wage entitlement
  • Non-performance (akṛta) and liability thresholds
  • Excuses for incapacity: illness, calamity, and unacceptable/degrading tasks
  • Substitution/delegation: permissibility and anti-obstruction safeguards
  • Partial performance: apportionment and anti–employer bad faith rules
  • Ācārya dispute: presence vs actual performance as completion
  • Guild (śreṇi) hired labour: ādhi (pledge), time-bounds, notice duties, replacement procedure

The policy

  • Who actsDharmastha (judge) and the King’s judicial-administration (vyavahāra-pravartaka) acting through courts and local authorities; guild leadership (saṃgha) as regulated intermediary.
  • Whom it governsWage-labourers (bhṛtaka), employers/masters (bhartṛ), and corporate labour bodies (saṃgha-bhṛta) engaged in contracted work.
  • Why force, and how muchContract sanctity: taking wages without rendering work is treated as a direct economic harm and a trust-violation; danda compels performance, deters opportunism, and preserves transactional confidence that feeds revenue and stability.

The administration

  • What the state doesAdjudication of wage-contract disputes: impose fine + confinement for wage taken without work; recognize incapacity defenses; authorize substitution/compelled completion; deny wages for non-performance; regulate partial-performance, delay/defective-performance, and guild replacement procedure.
  • Precedents and parallelsDharmasūtra/Dharmaśāstra traditions commonly penalize breach of service after taking wages; Kauṭilya is notably strict on ‘no wage without work’ and adds operational rules for guild-labour and substitution, emphasizing economic throughput over purely moral censure.

The philosophy

  • Artha and dharmaDharma is operationalized as enforceable fidelity to agreements; artha is protected by ensuring labour converts wages into output. Compassion is bounded: incapacity (vyādhi, vyasana) and ‘kutsite karmaṇi’ can mitigate, but not become a loophole for rent-seeking.
  • The strategyDaṇḍa (punitive enforcement) as the primary instrument, supplemented by procedural regulation (niyama) to prevent strategic obstruction by either employer or worker/guild.

For the administrator

  • Who it is forDharmastha/Adhyakṣa of Vyavahāra (chief judicial officer) coordinating with the Samāhartṛ (revenue) and relevant Adhyakṣas overseeing labour and guilds
  • The takeawayAdjudicate wage disputes by (1) proving actual performance or measurable partial performance, (2) testing claimed incapacity against recognized excuses, and (3) enforcing substitution and guild-notice procedures to prevent obstruction—thereby minimizing idle wage outflow and ensuring timely completion of work.

How it is written

Primarily prescriptive (rules and penalties) with limited interpretive/dialectical notes (ācāryāḥ vs. Kauṭilya).

Imagery

  • Low; no major state-metaphors. Language is transactional-legal and procedural.

Frequently Asked Questions

Higher trust in hiring and payment, fewer labour disputes, steadier production and service delivery, and reduced opportunistic default—supporting prices, supply reliability, and thus the Kośa and Janapada’s stability.

For a hired worker who takes wages but does not perform: a fine of 12 paṇas plus confinement (saṃrodha). In cases of obstructive exclusivity (employer preventing substitution or worker refusing performance under ‘only you/only me’ conditions), a 12-paṇa fine applies to the obstructing party.
