दण्ड: प्रत्ययदृष्टोडपि व्यवहारात्मक: स्मृत: । व्यवहार: स्मृतो यश्चव॒ स वेदविषयात्मक:,यद्यपि स्वामीके विश्वासके आधारपर ही वह दण्ड देखा गया है; तथापि उसे भी व्यवहारस्वरूप ही माना गया है। जिसे व्यवहार माना गया है, वह भी वेदोक्त विषयसे भिन्न नहीं है

daṇḍaḥ pratyayadṛṣṭo 'pi vyavahārātmakaḥ smṛtaḥ | vyavahāraḥ smṛto yaś ca sa vedaviṣayātmakaḥ ||

قال بهيشما: حتى إذا أُدركت الدَنْدَا (daṇḍa) على أساس الثقة والاقتناع المقبول، فإنها تُفهم مع ذلك على أنها من مجال الإجراء القضائي المشروع (vyavahāra). وكل ما يُعترف به بوصفه vyavahāra ليس خارج نطاق الفيدا، بل هو مؤسَّس على مبادئ فيدية. وهكذا فإن إنفاذ العقوبة والقضاء الاجتماعي، وإن اعتمدا على اعتقادٍ موثوق، يظلان أدواتٍ للدارما لا قوةً اعتباطية.
